1. Acceptance of Terms

By accessing or using MySched ("Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the Service. MySched is operated by MySched ("we", "us", or "our").

2. Service Description

MySched is a scheduling, billing, and messaging platform designed for service businesses and companies that manage sessions. The Service includes:

  • Session scheduling and calendar management
  • Automated billing and payment processing
  • Messaging integration with Telegram and WhatsApp
  • Multi-employee and multi-company support
  • Analytics and reporting tools
  • Role-based access control

3. Eligibility

You must be at least 18 years old and capable of forming a binding contract to use the Service. By using the Service, you represent and warrant that you meet these requirements.

4. User Accounts

To use the Service, you must create an account. You agree to:

  • Provide accurate, current, and complete information during registration
  • Maintain the security of your account credentials
  • Notify us immediately of any unauthorized use of your account
  • Accept responsibility for all activities that occur under your account

We reserve the right to suspend or terminate accounts that violate these Terms or engage in fraudulent activity.

5. Payments and Subscriptions

MySched offers multiple subscription tiers: Free, Solo, Small Team, and Enterprise. Pricing details are available on our website.

Subscription fees are billed in advance on a monthly or annual basis. By subscribing, you authorize us to charge your payment method automatically.

The Service allows you to automatically charge your clients for sessions. You are responsible for:

  • Setting appropriate pricing for your sessions
  • Ensuring you have authorization to charge clients
  • Complying with applicable payment processing regulations
  • Handling refunds and disputes with your clients

Subscription fees are non-refundable except as required by law or at our sole discretion. You may cancel your subscription at any time, effective at the end of the current billing period.

We reserve the right to change our pricing with 30 days' notice. Continued use of the Service after a price change constitutes acceptance of the new pricing.

6. Messaging Channels

MySched integrates with Telegram and WhatsApp to facilitate communication between employees and clients. By using these features:

  • You agree to comply with Telegram's and WhatsApp's respective Terms of Service
  • You acknowledge that messages are transmitted through third-party platforms
  • You are responsible for the content of messages you send through the Service
  • You must obtain appropriate consent from recipients before sending messages
  • We are not responsible for the availability or reliability of third-party messaging platforms

7. Acceptable Use

You agree not to:

  • Use the Service for any illegal purpose or in violation of any laws
  • Transmit spam, unsolicited messages, or harassing content
  • Impersonate any person or entity or misrepresent your affiliation
  • Interfere with or disrupt the Service or servers
  • Attempt to gain unauthorized access to any part of the Service
  • Use the Service to collect or harvest personal information about other users
  • Upload or transmit viruses, malware, or other malicious code
  • Violate any intellectual property rights
  • Engage in any activity that could harm minors

8. Intellectual Property

Ownership

The Service, including all content, features, and functionality, is owned by MySched and is protected by international copyright, trademark, and other intellectual property laws.

License

We grant you a limited, non-exclusive, non-transferable license to access and use the Service for your business purposes, subject to these Terms.

User Content

You retain ownership of any data, content, or information you submit to the Service ("User Content"). By submitting User Content, you grant us a worldwide, non-exclusive license to use, store, and process it solely to provide the Service.

Feedback

Any feedback, suggestions, or ideas you provide about the Service become our property and may be used without compensation or attribution.

9. Data and Privacy

Your use of the Service is also governed by our Privacy Policy, which describes how we collect, use, and protect your personal information. By using the Service, you consent to our data practices as described in the Privacy Policy.

10. Disclaimers

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO:

  • Warranties of merchantability, fitness for a particular purpose, or non-infringement
  • Warranties that the Service will be uninterrupted, secure, or error-free
  • Warranties regarding the accuracy, reliability, or completeness of any content

We do not guarantee that the Service will meet your requirements or that any errors will be corrected. Use of the Service is at your own risk.

11. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, MYSCHED SHALL NOT BE LIABLE FOR:

  • Any indirect, incidental, special, consequential, or punitive damages
  • Loss of profits, revenue, data, or business opportunities
  • Damages arising from your use or inability to use the Service
  • Damages arising from unauthorized access to your account or data
  • Damages arising from third-party messaging platforms (Telegram, WhatsApp)

Our total liability for any claims arising from these Terms or the Service shall not exceed the amount you paid us in the 12 months preceding the claim.

Some jurisdictions do not allow the exclusion of certain warranties or limitation of liability, so the above limitations may not apply to you.

12. Indemnification

You agree to indemnify, defend, and hold harmless MySched and its officers, directors, employees, and agents from any claims, liabilities, damages, losses, and expenses (including legal fees) arising from:

  • Your use of the Service
  • Your violation of these Terms
  • Your violation of any rights of another party
  • Your User Content

13. Termination

By You

You may terminate your account at any time by contacting us or using the account settings. Termination will be effective at the end of your current billing period.

By Us

We may suspend or terminate your access to the Service immediately, without prior notice, if you breach these Terms or engage in conduct that we deem inappropriate or harmful.

Effect of Termination

Upon termination, your right to use the Service will cease immediately. We will make reasonable efforts to provide you with access to export your data for 30 days after termination, after which your data may be deleted.

14. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify you of material changes by email or through the Service. Your continued use of the Service after changes become effective constitutes acceptance of the modified Terms. If you do not agree to the changes, you must stop using the Service.

15. Governing Law and Disputes

These Terms shall be governed by and construed in accordance with the laws of the jurisdiction in which MySched is registered, without regard to its conflict of law provisions.

Any disputes arising from these Terms or the Service shall be resolved through good faith negotiations. If negotiations fail, disputes shall be resolved through binding arbitration or in the courts of the jurisdiction in which MySched is registered.

You agree to resolve disputes on an individual basis and waive any right to participate in class action lawsuits or class-wide arbitration.

16. General Provisions

Severability: If any provision of these Terms is found to be unenforceable, the remaining provisions will remain in full effect.

Waiver: Our failure to enforce any right or provision of these Terms will not be deemed a waiver of such right or provision.

Assignment: You may not assign or transfer these Terms or your account without our prior written consent. We may assign these Terms without restriction.

Entire Agreement: These Terms, together with our Privacy Policy, constitute the entire agreement between you and MySched regarding the Service.
